
SUBMISSION TO NPA’s ADVISORY PANEL APPOINTED TO SELECT A NEW NATIONAL DIRECTOR OF PUBLIC PROSECUTION
SUMMARY
Public Interest SA submitted an assessment concerning the suitability of Adv Andrea Johnson for appointment as the National Director of Public Prosecutions (NDPP).
The submission is grounded in constitutional standards, the requirements of the
National Prosecuting Authority Act, and the governance norms expected of the
highest prosecutorial office in the Republic.
Our analysis draws on publicly available records, judicial commentary, internal NPA
developments, and key anti-corruption performance indicators.
After comprehensive evaluation, we conclude that Adv Johnson does not meet the
required threshold of independence, ethical leadership, prosecutorial rigour, or
public-trustworthiness.
KEY INITIATIVES
Key concerns include:
• her failure to recuse herself in matters affecting her husband, constituting a clear conflict of interest;
• the existence of serious allegations linking her spouse to factional battles within SAPS, creating severe perception risks;
• her misuse of prosecutorial authority in pursuing a matter that was plainly a SAPS HR/disciplinary issue;
• the premature and poorly prepared enrolment of the Matshela Koko State Capture prosecution, which collapsed at great financial and reputational cost;
• and broader performance deficits during her leadership of the Investigating Directorate.
The NDPP plays a pivotal role in safeguarding public trust, prosecutorial
independence, and constitutional integrity.
In our considered view, the cumulative concerns outlined in the attached submission
materially compromise Adv Johnson’s suitability for this critical appointment.

ensuring that South Africa is served by an NDPP of the highest integrity and
competence.
